Submission Procedure

The application, passport, and supporting documents should be submitted to the U.S. Embassy I Consulate or at the desinated VFS Center. The consular officer in turn will review the application and, in most cases, by the officials in Washington, D.C. Generally the visa is issued within a few weeks upon submission of the application, although there is no guarantee of obtaining a visa.

For certain applications, additional reviews are required. In such cases the information about the applicant is submitted and checked in the world's foremost security database, including the comprehensive information drawn from USA and foreign law enforcement agencies worldwide. If the name of the applicant or a close variation indicates security concerns, the process may get delayed.

Additional steps may vary from requesting for additional interviews and information to official registration and fingerprinting. This process may further delay the applicant from getting a visa by at least 4-6 weeks to the processing time. It is mandatory to register upon arrival in USA.

A student applying for a study visa should speak to the US academic institution or exchange program sponsoring the student to obtain all the forms required for submission along with the application.

A visa allows the visitor to travel from India to a port of entry in the USA. In most cases, that port of entry will be the airport where the visitor lands. On the airplane the visitor will be asked to complete a short arrival/ departure form. The visitor is suggested to follow the directions for non-citizen entry upon deplaning. At the airport a U.S. official will interview the visitor and verify all documents. Once admitted, the visitor will receive an immigration stamp and proceed to baggage claim and U.S. Customs.

The visitor may be informed by the consular office before leaving India weather or not he/ she is subjected to special clearance procedures. Some visitors may be directed to private workstations in the arrivals hall, where special registration, photos and electronic (ink-less) fingerprints will be taken.

Additional interviews and verification processes will be conducted. All applicants will be finger printed except children under 14 years, adults over 79 years, A-l, A­2, G-L G-2, G-3, G-4, C-3 and NATO applicants.

In certain consulates appointments and personal interviews have to be scheduled in advance, and in some consulates interviewing of an applicant is on a walk-in basis at specific, posted times. Confirm the same from the nearest consulate.

The time it takes to process the visa may also vary significantly depending on type of visa and circumstances.

Applicants must prove that they qualify under provisions of the Immigration and Nationality Act. They must demonstrate that they are properly classifiable as visitors under U.S. law.

The presumption in the U.S. law is that every applicant is an intending immigrant. Therefore, applicant must overcome this presumption by demonstrating that:

The purpose of the trip is to enter the USA for business, pleasure, or medical treatment;

That the applicant plans to remain for a specific, limited period only;

Evidence of funds to cover expenses in the USA;

Evidence of compelling social and economic ties in India; and That the applicant has a residence status outside the USA as well as other binding ties which will insure his/her return to India at the end of the visit.
