Employment Based Immigration (E Category Visas)
An Immigrant is an Indian national who is authorized to live and work permanently in the United States.

Based on the employment skills the Employment Immigration Visas are categorized into five major groups as given below:

EB-l Priority Workers

(1)Foreign nationals of extraordinary ability in the sciences, arts; education, business or athletics
(2) Foreign national that are outstanding professors or researchers
(3) Foreign nationals that are managers and executives subject to international transfer to the United States

EB-2 Professionals with advanced degrees or exceptional ability

(1) Foreign nationals of exceptional ability in the sciences, arts or business
(2) Foreign nationals that are advanced degree professionals
.(3) Qualified alien physicians who will practice medicine in an area of the u.s. which is underserved.

EB-3 Skilled or professional workers

(1) Foreign national professionals with bachelor's degrees (not qualifying for a higher preference category)
(2) Foreign national skilled workers (minimum two years training and experience)
(3) Foreign national unskilled workers

EB-4 Special Immigrants

(1) Foreign national religious workers
(2) Employees and former employees of the U.S. Government abroad

EB-5 Immigrant Investors

Procedure
Step I- Labor Certificate

The Sponsoring US employer and the Indian candidate together must establish the eligibility for the category under which the Indian national is seeking employment immigration.

The sponsoring US employer (except EB-1 Category) must request for a Labor Certification using Form ETA-750 to the Department of Labor's Employment & Training Administration, since most of the employment categories require this labor certificate along with the Visa Petition.

Note: Exemption - A qualified Indian physician who intends to practice medicine in US which has been certified as underserved by the US Department of Health and Human Services is exempted from Labor Certification requirement.

Step 2 - Visa Petition

The sponsoring US employer must file a petition with USCIS using Form I-140 enabling the Indian National to work in the U.S. on a permanent basis along with the Labor Certification

Step 3 - Petition Approval and Visa Number Availability

Once the USCIS approves the petition filed by the US employer the State Department allots an immigrant visa number to the Indian candidate. The immigrant visa assignment will be notified to the Indian candidate by means of visa number allotment to the visa petitioner.

Step 4 - Completion of Immigrant Visa Process

In case the Indian candidate is already in US, he / she must apply to adjust to permanent resident status after a visa number becomes available.

In case the candidate is in India during allotment of Visa Number, he / she will be informed by the nearest US consulate. Upon receipt of such information the Indian candidate must complete the process at the local US consulate.

Note:
All USCIS Form I-140 petitions must be filed at the USCIS Regional Service Center that has jurisdiction over the place where the individual will work.

The petition packet must include the required documentary evidence and should follow the specific filing guidelines of the Service Center.
