Blanket Petition

A Blanket Petition is a petition seeking continuous approval for the company and for all of its branches under L category. Under this process, the Service Center is responsible to establish whether the company and all its branches are qualified for approval of a Blanket Petition and to determine whether the Indian applicant is eligible for the L-I-A or L-I-B categories.

The approved blanket petition shall be finalized and indefinitely maintained by the appropriate Service Center. The petitioner will be considered as the single representative of that qualifying US Company with which the Service will deal regarding this blanket petition.

The petitioning US Company must include all of its branches, subsidiaries, and affiliates which may seek an Intracompany Transferee to US under the blanket petition. The company may also file an individual petition instead of using the blanket petition procedure.

Conditions governing Blanket petition:

 (1) The company and all of its branches must be dealing in commercial trade or services

(2) The company must have an office in US and should be doing business for one year or more

(3) The company must have three or more domestic and foreign branches and

(4) The petitioning company and all its branches must have obtained approved petitions for at least ten candidates under L category as managers, executives, or specialized knowledge professionals within the previous one year
(i) or have US subsidiaries or affiliates with combined annual sales of at least $25 million
(ii)or have a US work force of at least 1,000 employees.

Documents Required for a Blanket Petition

A blanket petition must be filed using Form I -129 along with the following:

(i) Documentary proof showing that the company satisfies the conditions for a blanket petition as mentioned above.
(ii) Documentary proof showing that all of its branches/ counterparts for which approval is sought for blanket petition are qualifying organizations as detailed above
(iii) Any such documentary proof that the director feels necessary to submit in for certain cases.
