J-2 Category - Spouse & Children of Exchange Visitor-J-l
The spouse and child of accompanying or following to join the J­1 exchange visitor can seek admission to enter DS under this category.
In case where the dependent is already added on the form DS-2019, he/ she may accompany the principle applicant under J-2 category. Applicant is advised to check the upper right hand corner of the Form DS-2019 to ensure the inclusion of the family members.

The person already with J-l visa may apply for Derivative J-2 visa to join the principal applicant in US. The age of the child must be below 21 years. In any case the derivative J-2 visa is not applicable for parents, in-laws or adult child whose age is more than 21 years

Additional Documents Required

(1) Complete photo copy of passport of the prime applicant.

(2) Additional documents if the prime applicant has been in US for some time, transcripts or proof showing that prime applicant is still engaged in the research (J-l).

(3) Proof showing that sufficient fund is available to support the prime applicant and the accompanying dependents. In case funding through scholarship or graduate assistantship must show the details containing the source of fund. If funded of own or by anybody else from India the original bank pass books will be the proof of fund availability.

(4) The prime applicant must show adequate financial proof to support self and the family in US.

Note: A spouse or child with a J-2 visa cannot seek employment in the U.s., but can attend school.

Extensions of stay for the spouse and children
The prime applicant must submit Form I-94 as an attachment to Form DS-2019 for each dependent and a list containing the names of the applicants, dates and places of birth, passport numbers, issuing countries, and expiration dates.

Employment
The accompanying spouse and minor children of a J-l exchange visitor may accept employment only with authorization by the Immigration and Naturalization Service. A request for employment authorization must be made on Form I-765, Application for Employment Authorization, with fee, as required by the Service, to the district director having jurisdiction over the J-l exchange visitor's temporary residence in the US.

Income from the spouse's or dependent's employment may be used to support the family's customary recreational and cultural activities and related travel, among other things. Employment will not be authorized incase this income is needed to support the J-l principal candidate.

Duration of the Employment
J-2 employment may be authorized for the duration of the J-1 principal candidate's authorized stay as indicated on Form I-94 or a period of four years, whichever is shorter.

The employment authorization is valid as long as the J-l applicant is maintaining status. Upon approval of the application for extension of stay, the dependent of J-l applicant can apply for renewal of the employment authorization using form I-765 along with the fee.
