Your Ad Here	EB-4 Special Immigrants Eligibility and Filing To qualify as an EB-4 special immigrant religious worker, the Indian candidate must be a member of a religious denomination that has a non-profit religious organization in the US for at least two years before applying for admission to the US. The Indian national must be entering the United States to work: (1) As a minister or priest of the religious denomination (2) In a professional capacity in a religious vocation or occupation for the religious organization (a professional capacity means that a U.S. baccalaureate degree or foreign equivalent is required to do this job) or
(3) In a religious vocation or occupation for the religious organization or its nonprofit affiliate. (A religious vocation means a calling or devotion to religious life. Taking vows can prove that the Indian candidate has a calling to religious life. A religious occupation is an activity devoted to traditional religious functions. Examples of religious occupations include (but are not limited to) cantors, missionaries, and religious instructors.)
Documents Required A petition for EB-4 category visa must be submitted on us as Form I-360 (Petition for Amerasian, Widow(er), or Special immigrant) and filed at the USCIS Regional services Center that selves the area where the intended immigrant will work and must also include: (1) Proof that the religious organization qualifies as a non-profit, organization. (2) A letter from an official of the religious organization in US (i) The letter should establish that the Indian candidate has been a member of the denomination for two years, and that he / she has at least two years of experience in the religious vocation or occupation. (ii) In case of a minister, the letter should establish that the candidate has been authorized to perform religious duties in general and should specify which duties he / she is authorized to perform. (iii) In case in a religious professional, the letter should establish that the Indian candidate has a US baccalaureate degree or the foreign equivalent that is required for this religious profession. He / she must also submit an official academic record. (3) If applying to work in the US in another religious vocation or occupation, the letter should establish that the Indian candidate is qualified to work in that religious vocation or occupation. For instance, if applying to work as a nun or a monk, he / she would need to provide evidence of being a nun or a monk.
Your Ad Here	(4) If the petition is for a non-ministerial or non professional capacity for a religious organization affiliated with a religious denomination, the letter should establish how the religious organization is affiliated with the denomination. (5) The letter should also detail how he / she will be carrying on the work of a minister, or how he / she will be paid in case working in a professional or other religious capacity. The letter should indicate that he / she will not be dependent upon supplementary income (from a second job) ox charity (funds solicited for his/her support)
