P-3 Category (Artist in Culturally Unique Program)
Who can apply?
Artists or entertainers, individually or as a group, intending to go to US for the purpose of developing, interpreting, representing, coaching, or teaching a unique or traditional ethnic,.

Folk, cultural, musical, theatrical, or artistic performance or presentation, can seek temporary admission to US under P-3 category, on commercial or non-commercial basis

Filing of Petitions

The sponsoring organization in US must file the petition using Form I-129 on behalf of the Indian artist. But the petitioner should not include the name of the Essential Support Candidate in the petition since this requires a separate petition

Documents required
The petition for the Prime Artist must include:

(1) Affidavits, testimonials, or letters from recognized experts attesting to the eligibility of the artist's or the team's skills in performing, presenting, coaching, or teaching the unique or traditional art form and giving the credentials of the expert, including the individual's knowledge and the team's skill, or

(2) Documentary proof showing that the performance of the individual or team is culturally unique, by means of reviews newspapers, journals, or other, established materials and

(3) Proof showing that each presentation of the team/ individual will be a culturally unique event.

The petition for the Essential Support Candidate of Prime Artist must include:

1. A consultation from an authorized Labor Organization which is expert in that art about the artist's skill

2. A letter describing the essential support candidate's previous essentialities, critical skills, and experience with the prime artist,

3. A copy of the contract or a summary of the terms of oral agreement between the supporting candidate and the employer.

Consultation

The authorized labor organization shall explain as to why the program to be performed is genuine and whether the program meets the requirements as mentioned above.

If the Labor Organization is not favorable to the petitioner, it must plain the statement of facts leading to such decision.

Petition Validity

Initial stay of an approved P-3 petition will be valid till completion the program and may not exceed maximum of one year.

Extension of Stay

The stay of a P-3 candidate may be granted in the increments of 1 year till completion of the program for which the admission was sought.
