Children under guardianship

Guardianship does not qualify for a family reunification visa because, unlike adoption, it does not establish a parentage link between the child and the guardian(s). A visa under this category can only be issued for humanitarian reasons, this generally refers to cases where a child has been declared abandoned or orphaned. Each case is decided on its own merits by the Immigration Service at Federal Public Service Home Affairs.

Documents required
 Two copies of duly completed and signed visa application Forms.
Two passport size photos of the applicant
Valid passport of the applicant with validity of at least 12 months
An official copy of the decision placing the applicant (child) under the guardianship or care of the individual to whom the applicant (child) wishes to join in Belgium. Copy of authorization from the relevant Indian authorities permitting the child to leave India permanently (unless this is already stated explicitly in the guardianship decision).

Copy of an official document confirming that the biological parents or the individual holding parental authority or previous guardianship over the applicant (child) give(s) their permission for the applicant to leave India (unless this is already stated explicitly in the guardianship decision) or an official document declaring that the applicant has been abandoned or that his/her parents have died. These documents must be drawn up in accordance with Indian legislation.

A medical certificate, (see Annexure BEL-III) obtained from the doctor designated by the Belgian embassy or consulate, dated and not older than 6 months from the date of application.
Official copy of the applicant's full birth certificate.
A pledge of financial support by the applicant's guardian.
Copy of the guardian's identity documents.

A certificate of good conduct (certificate de bonne vie et moeurs/bewijs van good gedrag en zed en) of the guardian.
Proof that there are no other relatives of the applicant (child) in India (to the third degree) who could take care of the applicant.
Proof that the applicant (child) is already dependent on the guardian.

Note:
1. Official documents issued in India or elsewhere must be legalised.
2. Documents issued in India in a language other than Dutch, English, French or German must be translated by a sworn translator.
3. The documents listed above are only the basic documents to be submitted. Additional documents may be requested by the embassy or consulate.
4. The applicant must report in person to the municipal authority at the place of his/her residence in Belgium within 8 days of the applicant's arrival in Belgium.
