Who Can Apply?
This visa is issued to a person who wants to enter Australia as a student. Student Guardian Visa (Sub class 580) is not given under this category.

Conditions

. The applicant must satisfy the specified criteria including financial ability, English language proficiency, intention to comply with visa conditions and other relevant matters.

. If the results of an English language test are to be provided, he must take the test before making the application.

Note - Merit Certificates are awarded to selected meritorious candidates & Participation Certificates are awarded to every candidate.

Important information for
this category

. A sub class 570 visa is for" those students who want to study English Language Intensive Courses for Overseas Students (ELICOS) in Australia. This includes:

courses that lead to a certificate I, II, III or IV  
courses that result in no formalAustralian award.
If plan to study ELICOS as a pre requisite to another course, applicant must apply for the visa appropriate to his / her main course of study. If plan to study several courses, the main course is the higher level course.

Example; Ifplan to complete a three-month ELICOS before starting a Bachelor of Artsdegree, applicant must apply forthe Higher Education Sector visa.

Note - Before applying forthis visa, applicant must have been accepted to study full time at an educational institution in Australia.

. A sub class 572 visa is for students applying to study in Australia and whose main course of study is a certificate I, II, III and N (except EUCOS), a diploma, an advanced diploma, a vocational graduate certificate or a vocational graduate diploma.

. A sub class 573 visa is forstudents applying to study in Australia and whose main course ofstudy is one ofthe following:
Bachelor degree
associate degree
graduate certificate
graduate diploma
Masters by coursework

. A sub class 574 visa is for students who want to study a Masters degree by research or a Doctoral degree in Australia.

. A sub class 575 visa is for students who want to study the following courses in Australia:

a non award foundation studies course other full time course (or components of a course) that does not lead to an Australian award.

Exception - If an applicant is studying a non award course as a pre requisite to another course, he / she must apply for the visa appropriate for his / her main course of study. If an applicant is studying several courses, the main course is the higher level course.

Example - If an applicant plans to complete a three-month non­ award foundation studies course before starting a Bachelor of Arts degree, he / she must apply for the Higher Education Sector visa.

. Applicant must declare on the application that he / she have enough money to pay for travel, tuition and living expenses for the applicant, his / her spouse and dependent children for the duration of the stay in Australia. Applicant must also have enough money to support his / her spouse and dependent children, even if they do not travel with the applicant to Australia.

The table below outlines the amounts required in Australian dollars (AUD$) as enough., money. These amounts are the minimum required. They do not necessarily represent the cost of living in Australia.

. All forms must be completed in English, and documentation provided in a language other than English must be accompanied by an English language translation. All documentation must be originals or certified or notarised copies (as indicated).

. In case of change in the information already provided in the application Form, the same must be notified to the Embassy in writing. Failure to do so may result in an assessment of the application based on out of date information.

. Application can also be lodged with the assistance of an Education Agent.

. The applicant an a any family unit member wanting a visa to travel with them to Australia must undertake medical and x ray examinations, if they are requested by the system, or they receive a follow up request from a processing officer, to undergo these examinations the applicant and any family unit members should present their health forms (issued by TTS) to the authorised Panel Doctor I Radiologist, with their passport, when they undergo their medical examination. To see the list of approved Panel doctors refer to Annexure'C at the end of this chapter.

Documents required

.  A duly completed and signed application for student Form 157A (see Annexure Australia XV).

. A duly completed and signed supplementary questionnaire to Form 157A (see Annexure Australia XVI).

. Completed Additional information sheet (see Annexure Australia  XVII).

. Personal Particulars for Character assessment form 80 (see Annexure Australia VIII).

. Details of Relatives M67. (See Annexure Australia II).

. Four recent passport size photos of the applicant. Write the name of the person on the back of each photograph.

. Photocopy of Passport page / s showing personal and issue details.

. Demand Draft of Visa fee.

. Marriage Certificate  if married.

. Previous passport. if any.

. Copy of the valid I ELTS results undertaken prior to the lodgment of the application. For English and IEL TS requirements refer to Annexure-B (at the end of this chapter).

. Letter of offer from the Institution (Original and Photocopy), stating the course, fee structure and the duration of the course opted for.

. Certificates and mark sheets for each year passed by the applicant should be provided and arranged according to the highest qualifications to the 10th class results.

. Work experience certificate (if applicable) from present and previous employers providing their contact details.

Personal documents

. Evidence of relationship between the applicant and all members of his I her family unit. Such as certified copies of birth certificates (including those who are not joining the applicant in Australia), Marriage certificate.

. If the applicant is living in a de-facto relationship, independent evidence that the applicant have been in the relationship for at least 12 months. Such as joint bank account statements, bills in joint names etc.

. If the applicant or anyone included in the application has been divorced or widowed, a certified copy of the divorce decree absolute or the death certificate of the deceased spouse.

. If anyone in the application has changed his / her name, certified copies of documents verifying the name change. Such as marriage certificate, a certified copy of evidence of name change.

. If any dependent child included in the application is adopted, certified copy of the adoption papers.

. Certified Copy of the documents to verify and access arrangements for children under 18 years of age. This is not required if both the parents are included in the application.

. If any family member has turned 5 years of age, but has not yet turned 18, and is going to remain with the applicant in Australia, provide evidence of enrolment in an Australian school, including payment of any required fee

Financial documents

. Provide evidence that the applicant have sufficient funds to cover the expenses of himself and his / her family members for living costs, tuition cost and school costs for any school age children for the first 24 months of the stay in Australia.

. Provide evidence that the applicant has access to funds to cover travel costs to and from Australia.

. Provide evidence for at least one of the following:
    (a) Money deposit from:
    A financial institution - in the name of the applicant or any individual's name. Funds must be held for at least 3 months immediately prior to the lodgment of the visa application.

Note - The 3 months saving history requirement does not apply if the applicant is applying for a further student visa to finish a course of study, and have successfully completed at least 75% of that course.

(b) Loan from:
A financial institution in the name of the applicant or any individual.
The Indian government.

(c) Scholarship from the Australian Education Provider.

(d) Scholarship or Financial Support from:

The Indian government.
The government of any third country.
Employer.
Multilateral agency. A. multilateral agency is an agency or organization in which at least 3 countries participate: e.g. The UN, World Bank and Asian Development Bank
Gazetted organization: e.g. Rotary International, Ford Foundation, National Red Cross and Red Crescent Societies.
Australian Government.
Australian State or Territory Government.
Acceptable non profit organization.  

Note - Applicants who are undertaking a course(s) of less than 12 months duration, or who are sponsored by the government of a foreign country, a multilateral agency, the Commonwealth Government, or the government of a State or Territory, and whose family members are not accompanying them to Australia, are only required to demonstrate access to sufficient funds to support these family members in India.

. Evidence of income (e.g. Income tax statement, income statement, business statement, saving history or any other evidence of regular income) AND evidence of relationship of person(s) providing financial support .

If the applicant is proposing to undertake a course, or package of courses, of less than 10 months duration, he/ she will be subject to a no further stay condition. This condition will prevent the applicant from applying for a further visa (other than a Protection visa, Student visa with permission to work or a Graduate-Skilled,
Visa) while he / she remain in Australia. However, the condition may not be applied to the visa if the applicant provides evidence of the following:

Additional funds for living costs for himself and his / her family unit members for another 12 months;
Additional funds for school costs for all of the applicant's school aged children for another 12 months;
An additional $12,000. This is a notional allowance for future tuition fees.
The above funds must be in addition to those funds already outlined above. The applicant must also provide evidence, as described above, for these funds. The applicant must provide evidence of additional funds for his / her family unit members even if they are not going to Australia.

If applicant is under 18 years of age

. Under 18 Consent Form evidence that every person with a legal right to decide where the applicant lives has consented to their proposed studies in Australia;

. Applicant's birth certificate;

. parent(s)'s passport or identification card;

. EITHERa signed statement from the education provider confirming appropriate arrangements have been made for the applicant's accommodation, support and general welfare in

Australia, OR the Under 18 Welfare Form(see Annexure Australia XIX) completed by the parents or person(s) who have legal custody of the applicant

. If accompanied with a Guardian, the guardian must complete an application for a student guardian visa form 157G (see Annexure Australia XVIII).

Additionally, the applicant must provide evidence of one of the following:

. If the applicant intends to reside in Australia with a parent or a person who has custody of them - evidence of their relationship and that they hold, or are applying for, a Student Guardian Visa for the length of the applicant's stay or until the applicant, turns 18, whichever is the lesser period. OR

. If the applicant intends to reside in Australia with a relative nominated by a parent or a person who has custody of them evidence of their relationship and that the relative is at least 21 years of age, has a police clearance, and has the right to remain in Australia for the period of the applicant's study in Australia, or until the applicant turns 18, whichever is the lesser period. OR

Note - Police clearances must be provided by the applicant's relative for every country in which tl1ey have resided for more than 12 months in the past 10 years (after the age of 16).

. If the applicant will not be residing in Australia with one of the above mentioned persons a signed statement from their education provider confirming appropriate arrangements have been made for their accommodation, support and general welfare during their stay in Australia.

If employed and sponsored by the employer

. A complete set of documents of past work experience.

. Reference letter from the current employer.

. Reference letter from the previous employer.

.Affidavit in support from the sponsor.

Balance sheet of the employer sponsoring the applicant. Copy of bond if signed with the sponsoring employer.

A letter from the employer giving details of the applicant's annual income and the reason of sponsorship.

If self sponsored or sponsored by parents etc

. Affidavit in support.

. Documentary evidence of the sponsor's annual income, personal bank statement and any other document to prove his sound financial standing: e.g. tak returns, property details, fixed deposits held etc.

. Details of all acceptable funds should be given in a table form duly certified by a Chartered Accountant.

. Bank loan Certificate (if applicable) applicant must provide details of collateral security.

. A certificate from the bank giving complete details of the last six months transactions including the current balances in the account.

. Documents to prove applicant's relationship with the financial sponsor: e.g. birth certificate, passport copy etc.

Family in India of student visa holder already in Australia

For all visa applications by a spouse or dependent childof a student visa holder already in Australia, the following additional documents MUST be provided:

. Original letter from the education provider with whom the student is enrolled stating

the course being studied;
the duration of that course and anticipated completion date; whether the student is satisfying course requirements;
for non government post secondary courses and ELICOS (only), the student's attendance record.

. Marriage certificate (original and a photocopy);

. Form 919  Student Dependent Nomination (from the sponsor who is currently pursuing education in Australia);

. Certified copy of ALL pages of the sponsor’s passport, including page with valid Australian student visa. The copy must be certified by a Justice of the Peace in Australia. Certified fax copies are not acceptable;

. Certified copy of ALL pages of the applicant's passport. The copy must be certified. Certified fax copies are not acceptable;

.A statement of history of relationship between the applicant and his / her spouse. Specify if it was an arranged marriage;
. Evidence of funds for the duration of the stay in Australia.

. Evidence of Overseas Student Health Cover (OSHC) for the duration of the stay in Australia;

Wedding photos;

Evidence of correspondence.

Note - Failure to provide complete documentation will result in delays. Evidence that Overseas Student Health Cover (OSHC) has been paid for the applicant and all family unit members applying with them (If the education provider has arranged the applicant's OSHC, this will be shown on the COE and separate evidence will not normally be required.)
