This visa is for children under 18 years of age whose parents are unable to care for them due to death, permanently incapacitated or unknown whereabouts. It allows the child to travel to and live in Australia with an Australian relative

. This visa allows the visa holder to live permanently in Australia, travel to and from Australia for five (5) years from the date the visa is granted.

Conditions

. The applicant must be under 18 years of age, at the time of application.

. The sponsor must be the child's brother or sister, grandparents, aunt or uncle, neice or nephew (or step equivalents) and be 18 years of age or over.

. The sponsor must be an Australian Citizen, Australian permanent resident or eligible New Zealand Citizen and lawfully residing in Australia for atleast 2 years.

. The applicant must be single, not married or in a defacto relationship.

. Sponsor must satisfy one of the following custody requirements when applying to sponsor a child under 18 years of age:
He / she must have the sole legal right to determine where the child shall live, or to remove the child from India.

If another person can legally determine where the child can live, the sponsor must obtain a statutory declaration from this person or people, granting permission for the child to migrate.

He / she must possess a valid court order from the Indian court allowing him / her to permanently remove the child from India.

He / she must have a court order issued by the Family Court of Australia and the grant of the visa must be consistant with that order.

Documents Required

. Duly completed and signed "sponsorship for a child to migrate to Australia Form" 40CH (See Annexure Australia XXVI) with all relevant documents.

. Duly completed and signed" Application for migration to Australia by a child" form 47CH (See Annexure Australia XXVII) with all releant documents.

. Evidence of payment of fee.

. Processing time is 6 to 9 months.

. Original Birth Certificate for each applicant. If an applicant does not have a Birth Certificate, a School Certificate bearing the date of birth will be accepted.

. Evidence of Australian citizenship or permanent resident status of the sponsor (e.g. Australian citizenship certificate or copy of passport pages which show identification page, permanent visa and any arrival! departure stamps for Australia);

. Death Certificates of any relatives (parents, siblings, and children) who are deceased. If the applicant does not have a Death Certificate for a deceased relative, he must submit a statement setting out when the relative died, cause of death and why he is unable to provide a Death Certificate;         

. Evidence of applicant's relationship to all his relatives (parents, siblings, children) in Australia. He must provide birth, marriage or school certificates which demonstrate the relationship between him and his relatives in Australia;
. Visa document on which the sponsor first migrated to Australia or permanent entry permit / visa granted to the sponsor after arrival in Australia (if the sponsor did not arrive in Australia as a migrant). If the applicant no longer has a copy of his initial visa, evidence of his file number or as many details about his visa as he can provide e.g. place and date of grant, visa class, name on his visa, visa number;    
  
. Statement from applicant's natural mother / father stating that she / he does not have an objection to his permanently migrating to Australia. Also, a photo identification document of the parent bearing his / her signature on it should be provided.

. Evidence that the sponsor is able to fulfill the sponsorship undertaking (refer to Form 40  Part I) (e.g. latest two year notice of tax assessment; current pay slips or other satisfactory evidence of alternative income; evidence of major assets, including bank or similar accounts, details of real estate / motor vehicle ownership).

. A court document may be required to satisfy that the law of the applicant's home country permits the migration of the applicant.

. 4 passport size photographs for all applicants.
