Who Can Apply?
New Zealand family relationship visa is issued to non New Zealand family members of a New Zealand citizen holding Special Category Visa (SCV). New Zealand citizens who arrive in Australia and do not hold a permanent visa are automatically granted a Special Category Visa (SCV),
which allows them to remain in Australia indefinitely. Accompanying family members (dependent children) to subclass 461 applicants can also be included in their application at no extra cost. This visa allows the holder to live and work in Australia for a period of up to five years.
Important information for this category
. All family members must apply for their own visa as a family member of the Special Category 'visa holder. One cannot make a combined application on the one form.
. Visa can be renewed, even if the relationship with the Special
Category visa holder has ended, provided that:
applicant have maintained Australian residency; applicant is in Australia for a total of at least two (2) years in the last five (5) years
Applicant continues to meet standard health and character requirements
applicant does not become the member of a family of another person (other than another Special Category visa holder)
if the applicant is outside Australia at the time of making the application and, has held this visa when he / she left Australia.
Applicant must be a member of family to the Special Category visa holder as one of the following:
their spouse
their (or their spouse's) dependent child
the dependent child of their (or their spouse's) dependent child
their (or their spouse's) relative who meets all of the following:
(i) is widowed, divorced, separated or has never married
(ii) is usually resident in the Special Category visa holder's household
(iii) is dependent on the Special Category visa holder.
. If an applicant lodges the application in Australia, he / she must be in Australia at the time that a decision is made on the visa application.
If he / she lodges the application from India, he / she must be in India at the time that a decision is made on the visa application. Under this situation the applicant must be accompanied to Australia by the Special Category visa holder.
75% of applications for this visa are processed within four (4) months.
. Proof that the applicant is the family member of a Special Category Visa holder and is not eligible for a Special Category Visa because he / she is not a New Zealand citizen.
. Proof of relationship with the Special Category Visa holder such as, marriage certificate, full birth certificate, death certificate etc. for each person (certified copies).
. Provide a family tree / diagram of the relationship.
