Who can apply?
. A person sponsored by an Australian business (including Regional Headquarters Agreement) (RHQ) or Labour Agreement (LA).

. A person sponsored by a business in India.

. A person sponsored by an Australian business as an intra company transfer.

. A person who is a holder of an independent executive visa who has an established business' in Australia.

. A person accorded certain privileges and immunities under the International Organisation (Privileges and Immunities)
Act 1963 or the Overseas Missions (Privileges and Immunities) Act 1995.

. Accompanying family members (spouse and child). (At no extra cost).

Important information for this category

. All subclass 457 applications with an Indian Business sponsor (OBS) can apply in India.

. All other subclass 457 Primary applications and Dependent applicants must apply online or Australian Business Centre.

. Nomination means a business to nominate a position they wish to fill with a temporary business entrant.

Sponsored visa applicants include the following:

the primary visa applicant. The primary visa applicant is the employee being sponsored to work temporarily in Australia.

Secondary visa applicants. Secondary visa applicants are family unit members of the primary visa applicant. This includes spouse, dependent children and other relatives who are wholly or substantially reliant on the main applicant for financial support for their basic needs.

. This visa entitles the holder to:

work in Australia for a period of between three (3) months and four (4) years
bring any eligible secondary applicants with them to Australia secondary applicants can work and study
after entering Australia, have no limit on the number of times they travel in and out of Australia.

. The validity period of this visa is:
sponsorship - 2 years
nomination - 2 months
visa - between 3 months and 4 years.

Documents required

. A duly completed and signed form 1066 (see Annexure Australia XIII).

. Personal Particulars for Character assessment form 80 (See Annexure Australia VIII).

. Details of Relatives M67 (See Annexure Australia II).

. A duly completed Form 1066 Part A or B.

. Four recent passport size photos for each person included in the application.

. Valid passport with two unused visa pages for each person included in the application.

. Demand Draft of Visa fee.

. Separate demand draft payable to the appropriate courier for applicants who wish to have their passports returned by courier.

. Valid passport with two unused visa pages for each person included in the application.

. Previous passport , if any.

. Evidence of applicant's employer's approved nomination and sponsorship (letters from the Department of Immigration and Multicultural and Indigenous Affairs) .

. Evidence of certification from the relevant Regional Certifying Body (RCB) if applicant is sponsored by an employer in a regional area

. Evidence of applicant's employment experience for the previous five years (or for. the period of employment if less than five years). This should include employment references, appointment and resignation letters, duty statements, salary advice and I cards. Please provide any two of the mentioned documents which confirm the period of employment with each employer

. Evidence of educational and professional qualifications

. A clear description of occupation and complete contact details of the employer are to be included on the application form. Please note that occupation titles such as 'business' and 'service' are not acceptable

. Marriage certificate (if spouse is included in the application or applies subsequently) along with marriage photographs.

. Birth certificate of each applicant included in the application. Applicants who do not have a birth certificate may submit their Secondary School Certificate or Higher School Certificate issued by the relevant State Education Board

. Dependents applying separately should provide:

a copy of the primary applicant's visa
approved nomination and sponsorship documents
a letter of support from the primary applicant's employer which clearly states that the employer is whiling to extend sponsorship obligations to the dependents where the dependents are not already included in the nominations.

Note -
(a) Documents not in English must be accompanied by an English translation,
(b) Provide the original documents and one copy of the original (originals will be returned to applicant after          completion of the assessment),
(c) From 1 June 2004 where a business in India or Nepal has lodged a sponsorship application with the Visa Office, visa applications under that sponsorship should be lodged at a TT Services collection centre.
