Who Can Apply?
Persons who are old enough to be granted an Australian age pension (it, however, does not mean that he will receive the age pension, there is a waiting period of ten years.)

. single, widowed, divorced or formally separated from spouse.

. wholly or substantially dependent on their relative for financial support, for at least three years before their application,

Conditions

. The applicant should be sponsored by a close relative who is: An Australian citizen, or Australian permanent resident, or Eligible New Zealand citizen.

. A close relative could be: a child, adopted child, parent, brother, sister, uncle, aunt, niece' or nephew (or step relatives) and
over the age of 18.

Important information for this category

. This visa allows aged persons who rely on a relative in Australia for all, or most, of their living costs to migrate to Australia. It allows the holder (and his / her dependent family members) to live as permanent residents in Australia and work and study in Australia receive subsidised healthcare through Medicare and the Pharmaceutical
Benefits Scheme (PBS)
access certain social security payments (subject to waiting periods)
be eligible to apply for Australian citizenship (subject to the residency eligibility criteria)
sponsor people for permanent residence (subject to waiting periods).

Example - A woman born in 1943 will have to wait until 2006 (when they turn 63) before they can apply for this visa.

. Applicant must have a commitment by a person prepared to provide him/her with an Assurance of Support.
An Assurance of Support is a legal commitment by a person (not necessarily the sponsor) to repay to the Australian Government certain welfare payments paid to migrants during their respective Assurance of Support period. Respective Assurance of Support periods are:

10 years for Contributory Parent visa holders or
2 years for all other visa types where an Assurance of Support is needed.
The Assurance of Support scheme enables welfare costs for these migrants to be met by an Australian permanent resident or citizen, rather than the Australian community.

. Following family members can be included in the application:
other dependent relatives
dependent child.
These family members must meet the requirements to be eligible to be included in applicant's visa application.

. Applicant's child (natural, adopted or step child) to be considered as dependent must be:
under 18 years of age
aged 18 years or over and have been wholly or substantially reliant on the applicant for a substantial period for their basic needs (food, clothing and shelter)
of any age and incapacitated for work due to a total or partial loss of bodily or mental functions (whether or not they migrate with you).
A child of any age is not considered dependent if he / she is married, engaged to be married or in a de facto relationship.

. Other relatives to be considered as dependent must be:

wholly or substantially reliant on the applicant for financial support for their basic living needs (food, shelter and clothing)
more reliant on the applicant for support than on any other person or source have been reliant on the applicant for a substantial period.

Note - Details of each dependent 18 years or older, whether migrating or not, must be provided.

All dependent family members must meet health requirements and will need to undergo a health examination.

Within the family stream, parent and aged dependent relative visa applications are given a lower processing priority than other family members such. as partners and children. Within the parent visa categories, the contributory parent category has a higher processing priority than the parent category.

Documents Required

. Duly completed and signed" Application for migration to Australia by other family members" Form 470F. (See Annexure Australia XXX).

. Duly completed and signed "Sponsorship for migration to Australia" Form 40 (See Annexure Australia XXXI. (This form must be provided by the sponsor to the applicant for submission with the application).

. Duly completed and signed "Details of child or other dependent family members aged 18 years or over" Form 47 A (if required) (See Annexure Australia XXII).

. Required Application Fee.

. Original Birth Certificate for each applicant. If an applicant does not have a Birth Certificate, a School Certificate bearing the date of birth will be accepted. Applicants born before 1940 who are unable to provide either a Birth Certificate or a School Certificate must submit an affidavit with birth details. 

. Applicant must prove that he / she does not have a spouse (married or defacto). To establish the current marital status applicant should provide official documents such as death certificate of previous spouse etc.

. If divorced, intermediate and final Divorce Decree, or Legal Separation Agreement including court decision on child custody where applicable (or decree nisi in the case of the sponsor). If the applicant or his sponsor is widowed, Death Certificate of the applicant's or sponsor's deceased spouse.

. Applicant must provide evidence that he / she have been wholly or substantially dependent on his / her relative in Australia for financial support for his / her basic needs for food, shelter and clothing or because he / she have a disability which prevents the applicant from working. This support must have been continuing for at least 3 years.

. Form 47 A (See Annexure Australia XXII) must be completed for each child or other dependent family member aged 18 years and over.

. Sponsor's Birth Certificate. If the sponsor does not have a Birth Certificate,' a School Certificate bearing the date of birth will be accepted. Persons born before 1940 who are unable to provide either birth certificate or a school certificate must submit an affidavit with birth details.

. Evidence that the sponsor is able to fulfill the sponsorship undertaking (refer to Form 40  Part I) (e.g. latest two year notice of tax assessment; current pay slips or other satisfactory evidence of alternative oincome; evidence of major assets, including bank or similar accounts, details of real estate/motor vehicle ownership).

. Evidence of Australian citizenship or permanent resident status of the sponsor (e.g. Australian citizenship certificate or copy of passport pages which show identification page, permanent visa and any arrival / departure stamps for Australia).

. Evidence of applicant's relationship with all his relatives (parents, siblings, children) in Australia. The applicant must provide birth, marriage or school certificates which demonstrate the relationship between him and his relatives in Australia; Visa document on which all his relatives (parents, siblings, children) first migrated to Australia or permanent entry permit/visa granted to his relatives after arrival in Australia.

. Death Certificates for any relatives (parents, siblings, and children) who are deceased. If the applicant does not have a Death Certificate for a deceased relative, he must submit a statement setting out when the relative died, cause of death and why he is unable to provide a Death Certificate.

. If served in the armed forces of any country, including India, certified copies of military service record or discharge papers.

. 4 passport size photographs for all applicants.
