Who is Allowed to Work in United States
Only a person who has permanent status and holds a green card or a special visa for non-immigrant workers can work in the US. Legislation penalizes employers who knowingly hire people who are not authorized to work. Most employers do want to see evidence of work permission before hiring, but there are others ready to take advantage of a worker's illegal status to exploit him, pay substandard wages, avoid deducting incomes tax or social security, or deny the worker the normal benefits.

This has led to very undesirable situation in some instances. So it is important to go into all possible aspects of an applicant's case before he/she gets to the United States. That is why even when a person wants to visit or study there, it is necessary to prove that the stay will be temporary.

Almost every visa applicant is interviewed. The authorities have to get the sense of the whole situation. It is not merely a question of whether the person has a relative in the United States, or a good command of English, or a job waiting on return to India. It's more a question of all the circumstances taken together. Where will the money come from? What are the family circumstances? If the applicant is working, what kind of job is it? What are his/her financial obligations? The concerned authorities look at all these facts, and listen carefully to anything else the applicant wants to tell them to show that the stay will be only temporary.

A visitor visa, for instance, is pretty simple and usually involves very little documentation. People go to see relatives or friends or acquaintances who put them up and take care of their expenses for a relatively short while. The financial question is usually secondary in these cases. Sometimes just a letter is other sufficient evidence that somebody is waiting at the end.

Can one stay after the validity period of one's visa is over?

No, definitely not. It is a slip of paper-Form 1-94 indicating how long the holder may stay and in what capacity. Tourist visas for Indians are usually valid for one year, but that means only that the person can travel to the United States any time during that one-year period. Student visas, issued for one year, allow a single entry into the United States
